Acceptance of Terms

By using the MyCrashCase website or services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

MyCrashCase operates as an attorney referral service connecting accident victims with qualified attorneys. We are not a law firm and do not provide legal advice or representation.

Description of Service

What We Provide: MyCrashCase connects individuals who have been in motor vehicle accidents with qualified attorneys in their geographic area who specialize in personal injury law.

What We Don’t Provide:

  • Legal advice or consultation
  • Legal representation
  • Guarantees about case outcomes
  • Attorney services directly
  • Case management or legal services

Service Limitations:

  • Not all users will qualify for attorney referrals
  • Attorneys may decline to take your case
  • Referral availability depends on attorney capacity
  • Service areas are limited to where we have partner attorneys

User Responsibilities

Accurate Information: You agree to provide truthful, accurate, and complete information when using our referral service. False or misleading information may result in inappropriate attorney matches or service denial.

Proper Use: You agree to use our service only for legitimate personal injury referral purposes. You may not:

  • Submit false accident claims or information
  • Use our service for commercial solicitation
  • Attempt to contact attorneys outside our referral process
  • Share login credentials with others
  • Misrepresent your identity or case details

Communication: You agree to respond promptly to attorney communications and maintain professional conduct during all interactions arranged through our service.

Attorney Relationships

Independent Contractors: All attorneys in our network are independent contractors. MyCrashCase does not control, supervise, or direct their legal services or professional judgment.

Attorney-Client Relationship: Any attorney-client relationship is formed solely between you and the referred attorney. MyCrashCase is not a party to this relationship and assumes no responsibility for attorney performance or case outcomes.

Attorney Selection: While we pre-screen attorneys for basic qualifications, you are responsible for evaluating whether a referred attorney is suitable for your specific needs and circumstances.

No Guarantee of Representation: Referral to an attorney does not guarantee they will accept your case. Attorneys may decline representation for various reasons including conflicts of interest, case merit, or capacity limitations.

Fees and Payments

No Cost to Users: Our referral service is provided at no cost to accident victims. You will never pay MyCrashCase for attorney referrals or connections.

Attorney Fees: Any fees owed to attorneys are separate agreements between you and the attorney. We do not set, control, or collect attorney fees.

Referral Compensation: MyCrashCase receives compensation from attorneys when we successfully refer clients who retain their services. This does not increase your legal fees or affect attorney selection criteria.

 

Privacy and Data Use

Your use of our service is also governed by our Privacy Policy, which is incorporated into these terms by reference. By using our service, you consent to our collection and use of personal information as described in our Privacy Policy.

Information Sharing: You authorize us to share your contact information and case details with qualified attorneys for referral purposes. This sharing is limited to attorneys who may be able to assist with your case.

Disclaimers and Limitations

No Warranties: Our referral service is provided “as is” without warranties of any kind. We do not warrant that:

  • You will be matched with an attorney
  • Any attorney will accept your case
  • Our service will be uninterrupted or error-free
  • Referred attorneys will achieve specific results

Limitation of Liability: MyCrashCase’s liability is limited to providing referral services. We are not liable for:

  • Attorney performance or malpractice
  • Case outcomes or damages awarded
  • Delays in attorney response or service
  • Costs or expenses related to your legal matter
  • Any damages arising from attorney-client relationships

Maximum Liability: In no event shall MyCrashCase’s total liability exceed the amount you paid to us for services (which is zero for referral services).

Intellectual Property

All content on our website, including text, graphics, logos, and software, is owned by MyCrashCase or our licensors and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our website content without written permission.

 

Modification of Service

We reserve the right to:

  • Modify or discontinue our referral service at any time
  • Change our attorney network or qualification criteria
  • Update our matching algorithms or processes
  • Refuse service to any user for any reason

We will provide reasonable notice of material changes when possible.

Termination

Your Right to Terminate: You may stop using our services at any time. Existing attorney referrals and relationships will continue according to separate agreements with those attorneys.

Our Right to Terminate: We may terminate or suspend your access to our services for violations of these terms, suspicious activity, or other legitimate business reasons.

Effect of Termination: Upon termination, your right to use our services ends immediately, but these terms remain in effect regarding prior use of our services.

Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

Dispute Resolution: Any disputes arising from these terms or our services shall be resolved through binding arbitration in Fulton County, Georgia, under the rules of the American Arbitration Association.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

 

Changes to Terms

We may update these Terms of Service periodically. Material changes will be posted on our website with a revised effective date. Your continued use of our services after changes constitutes acceptance of the updated terms.
